Can the collection agency garnish my wages in FL for a car repo? i make less then $500 a week.?
Garnishments can only occur with a court order. The first step for the agency is to obtain a court judgment against you for the balance owed. At that point (if they obtain one), you are obligated to make an agreement to pay the debt. If you cannot come to an agreement on payments or if you do agree but fail to make the payments, the agency can return to court and ask for relief, which can come in a number of forms, including garnishment. You will be notified at each step - do NOT fail to show up at your court date. If you fail to show, the judge will issue a default judgment (meaning you automatically lose). If you do show up, you can argue hardship or whatever to try to keep the judgment and/or garnishment to a minimum.
